rule 16 when downwinding

Hi all,
Please have a look at the 8'35'' incident of the attached replay.
Rules involved 16.1 and 16.2, to keep clear definition needed as well.
Harald cannot argue Jiel broke 16.1 because he had the whole sea behind me to keep clear.
Harald cannot argue Jiel broke 16.2 because this rule applies on a beat to windward.
On my side, I argue Harald broke rule 10 because he didnt keep clear which would had implied that I could change course without immediately making contact. In sailing too close to me, Harald failed to keep clear.

Finally I remembered to check the forum as suggested. I'm on mobile now, which means I haven't seen the replay. But there is something in the text I would like to comment on .

16.2 does not apply. But your statement that 16.1 is not relevant because the whole sea is available behind you, is not valid. In that case it would not be possible for you to break rule 16.1 at all.

If the course change by you caused immediate contact then I was not keeping clear by definition, even on opposite tacks since we both were sailing more than ninety degrees TWA.
