I assume there was no hail for room to tack from Mac Yawel.
Without Alb on the water, this would have been a simple case.
But with Alb there, at a certain time it becomes an "impossible situation".

1. It's impossible for Jiel to pass behind Alb.
2. It's impossible for Mac to pass behind Alb.
The picture below is a reference for these two facts (time in replay = 11:50):

Mac is doomed, he has no way out if the situation since he didn't hail RTT, so we would get a penalty no matter what he does.
When it's impossible for Jiel to pass behind Alb, he can't bear away, so the 11 pen is ok on him too, no exoneration.

Conclusion pen to both boats.
Both took penalties.
Mac was stopped from the crash, but he was last before the crash and he would have been last if he didn't break the rules.
So no grounds for additional pen points to Jiel for gaining advantage.

I agree, i had to prepare my boat to pass behind alb a few second before, or hail RTT ( i must find a short keyboard message for that)
